No sympathy for employees forging documents for jobs: Delhi HC

New Delhi: Employees, who are guilty of turning in forged documents to their employer, do not deserve sympathy or compassion and must be dealt with strictly, the Delhi High Court observed. It upheld the dismissal of a woman from service, PTI reported.

The court was hearing a plea by a woman who was earlier given a compassionate appointment in the Bihar Bhawan here in the Group IV category after the death of her husband. She approached the court seeking cancellation of a 2014 order by her employer terminating her service.

"Employees who are guilty of submitting forged documents to their employer have to be dealt with in a strict manner. If a person submits forged and fabricated documents, then such a person is certainly unfit to be employed. No sympathy or compassion can be shown to such an employee. Thus, when the charge against the petitioner stands proved, the punishment of dismissal from service imposed by the respondent cannot be faulted with," Justice Mini Pushkarna ruled.

Alleging causing nuisance and disturbance inside Bihar Bhawan under the influence of alcohol, the woman was sent a show cause notice in 2009. She was suspended later after a preliminary enquiry came to light that her educational qualification document, of class 8 pass, was forged. She was terminated from service after.

The High Court noted that the Enquiry Officer clearly found and established that the document submitted by her was forged, and the petitioner was not able to prove it otherwise.

The court ruled in its May 18 order that the woman was guilty of suppression of material facts and documents even before that court.
