Transfer judge for ‘insulting’ advocate: Kerala HC advocates to demand

Thiruvananthapuram: The Kerala High Court Advocates’ Association will approach the Chief Justice of India (CJI) seeking to transfer Justice A Badharudeen from the High Court, days after the justice was accused of insulting an advocate, The Indian Express reported.
Lawyers boycotted Justice Badharudeen’s court after he allegedly insulted in open court an advocate, who had lost her husband in January, according to Bar and Bench. The boycott was later withdrawn.
The association in a petition to Kerala HC Chief Justice Nitin Jamdar last week acknowledged that it had received complaint accusing Justice Badharudeen of misconduct in the courtroom.
Subsequently, the association on Monday decided to write to the CJI demanding the transfer of Badharudeen out of Kerala.
Meanwhile, Association secretary M R Nandakumar made it clear that lawyers will not continue boycott Justice Badharudeen’s court.
Alongside, the association demanded to video recording the proceedings at the High Court and decided to stay away from proceedings if it is not implemented, according to the report.
The association in a letter to HC Chief Justice last week said that despite the Kerala High Court being the first to implement e-filing and virtual courts, ‘but for strange reasons, we have not embraced transparency’. The lawyers body highlighted the absence of video recording and demanded the same to be introduced in a time-bound manner failing which lawyers would keep away from court proceedings.
Meanwhile, Justice Badharudeen reported in the court on Monday morning, completed hearing the cases that came up for his consideration in the morning session itself and returned to his chamber.
