HC quashes vigilance court order against former DGP Senkumar

Kochi: In a relief to former Kerala Police chief T P Senkumar, the Kerala High Court today quashed a vigilance court's order for a quick verification into allegations of corruption against him.

Allowing the petition filed by Senkumar challenging the Thiruvananthapuram Vigilance Court's order, Justice K Abraham Mathew also set aside the complaint levelling the allegations against the former DGP.

The vigilance court had issued the order on a complaint filed by a local CPI(M) leader in Thiruvananthapuram.

"In the case in hand, it has already been noticed that the pendency of the complaint causes —- in fact, has already caused —- irreparable injury to the petitioner," the high court said.

It was alleged that Senkumar had illegally granted two loans while holding the post of managing director, Kerala Transport Development Finance Corporation (KTDFC) in 2010.

The complaint was filed before the vigilance court, alleging that Senkumar had abused his official position to sanction a big loan to a businessman.

"The court will be failing its duty if it does not quash the complaint, which has been filed only to make sure that the petitioner (Senkumar) is not appointed a member of the Kerala Administrative Tribunal," the high court said.

In its order, the high court also said it would be doing a disservice to the cause of justice if it does not put an end to the complaint, which is a gross abuse of the process of the court.
