SC terms Patna HC’s remarks on widows as ‘highly objectionable’

New Delhi: The Patna High Court's statement that a widow does not need to wear makeup was described as "highly objectionable" by the Supreme Court on Wednesday.

LiveLaw reported that the comments were made during the SC's hearing of a case involving the abduction and murder of a woman due to a property dispute.

Police discovered makeup items in the house, and witnesses connected to the dead claimed she was living there at the time of the crime. It was discovered that the items belonged to a different woman who lived in the house, the Wire reported.

The Patna High Court made the observation that the woman could not have been the owner of the makeup items because she was a widow and did not need them.

Taking objection to the remarks made by the Patna HC, the bench of Justice Bela M. Trivedi and Satish Chandra Sharma said, “In our opinion, the observation of the High Court is not only legally untenable but also highly objectionable. A sweeping observation of this nature is not commensurate with the sensitivity and neutrality expected from a court of law, specifically when the same is not made out from any evidence on record.”
