CJI BR Gavai, Rakesh Kishore.

New Delhi: Advocate Rakesh Kishore has been freed in the matter of throwing a shoe at Chief Justice of India BR Gavai. The 71-year-old was freed on the instructions of the CJI himself. The Registrar General has also directed the Delhi Police to hand over the shoes used for throwing and the documents seized from him.

The Bar Council of India on Monday ordered the immediate suspension of advocate Rakesh Kishore. Issuing the interim suspension order, BCI chairperson and senior advocate Manan Kumar Mishra said the advocate's act was “prima facie inconsistent with the dignity of the court” and in clear violation of the professional conduct rules prescribed under the Advocates Act, 1961 and Bar Council of India Rules.

“On the basis of prima facie material, it appears that at about 11.35 am on 6 October 2025, in Court No. 1 of the Supreme Court of India, you i.e. Advocate Rakesh Kishore, enrolled with the Bar Council of Delhi vide enrolment nos..., removed your sports shoes and attempted to hurl them towards the Hon'ble Chief Justice of India during ongoing proceedings, whereupon you were detained by security,” the BCI said

The lawyer hurled his shoe towards Chief Justice of India BR Gavai during proceedings in the Supreme Court on Monday, PTI reported, citing lawyers’ accounts. The incident occurred when a Bench led by the CJI was hearing the mentioning of cases by lawyers. Kishore approached the dais, removed his shoe, and tried to throw it towards the judge. Alert security personnel present inside the courtroom immediately intervened and prevented the attack. Kishore was swiftly escorted out of the court premises.

As he was being taken away, the lawyer was heard shouting, “Sanatan ka apman nahi sahenge” (We will not tolerate the insult of Sanatan Dharma). The CJI remained composed and urged lawyers present in the courtroom to continue with their arguments.

“Don't get distracted by all this. We are not distracted. These things do not affect me,” the Chief Justice remarked.

Following the attack, the Delhi Police's security wing questioned Kishore for about three hours. The police allowed the advocate to leave after the Registrar General of the Supreme Court informed them that there was no complaint against him and that he should be released.

Police found that he was carrying identity cards of the Supreme Court Bar Association, Shahdara Bar Association and Delhi Bar Council. There was also a note in his possession, written on a white piece of paper that said, "Hindustan will not tolerate any direct insult to Sanatan Dharma."
