Delhi car horror: court adjourns hearing accuseds bail plea

New Delhi: The Rohini Court in Delhi has adjourned the hearing of the bail plea by Ashutosh Bhardwaj, one of the seven accused involved, Ashutosh Bhardwaj, in the Delhi car horror, on Tuesday. The hearing is adjourned for Thursday, Asian News International reported.

In the case, a woman who was riding a scooty was hit by a car, and her body got tangled in the vehicle. The car did not stop but dragged her body for 12 km in the early hours of New Year’s day. The woman’s body was found with clothes peeled off along with her skin.

The accused six others are under judicial custody.

It was the link Metropolitan Magistrate who adjourned the case since the judge concerned was not available on Tuesday. Advocate Shilpesh Chaudhary, Ashutosh’s counsel, pleaded with the linked judge to list the case before the concerned judge.

On Monday, the court of Metropolitan Magistrate Sanya Dalal directed the Delhi Police to respond to Ashutosh’s bail plea. Additional public prosecutor (APP) Atul Srivastava, appearing for Delhi Police, told the court that the probe into the matter was at the final stage and requested the court to send the accused to judicial custody.

But, advocate Shilpesh Chaudhary insisted on bail. He submitted that the accused had been charged with 201, 212, and 120B part 2 and these sections are bailable in nature.

He also submitted that Ashutosh’s only role in the incident was he allegedly gave his car to his friend and parked it. He cooperated in the recovery of the car as well as the arrest of the accused, the advocate added.

The court said that there is section 304 IPC against Ashutosh, but the accused’s counsel argued that another accused, Ankush, is on bail and is charged with 304, and the section was not made out against Ashutosh.

But APP said that Ashutosh gave his car to a person who has no driving licence, and whether he is involved in the crime does not matter. The APP added that they are opposing the bail application, the investigation was at the initial stage and facial recognition, medical tests etc., needed to be done as part of it.
