Nainital: The Uttarakhand High Court refused to quash an FIR against gym owner Deepak Kumar—known as "Mohammad Deepak"—stemming from a January 26 clash with Hindutva activists harassing a Muslim shopkeeper over his shop's name.

Justice Rakesh Thapliyal dismissed Kumar's petition, noting offenses carry sentences under seven years. "The Investigating Officer shall follow the guidelines formulated by the apex court in the case of Arnesh Kumar and will issue a notice to the persons concerned," the court ordered, directing notices to those concerned and urging cooperation. It rejected pleas for police protection and a probe into alleged police bias, calling the latter "wholly unwarranted" and harmful to morale, Bar and Bench reported.

The court barred Kumar from commenting on social media about the case, citing risks to the probe. It noted state claims of his non-cooperation and "busy on social media" activity, warning against messages or videos on the incident. Kumar's counsel protested: "Everybody is on social media. What illegal (act) have I done? Have I said anything unconstitutional? It is not a crime"

The FIR followed Kumar confronting Bajrang Dal activists demanding an elderly Muslim shopkeeper drop "Baba" from his sign, deeming it Hindu-exclusive. Asked his name, Kumar replied "Mohammad Deepak," sparking praise for Muslim solidarity but also Hindutva backlash, including death threats.

The court stressed trust in police for safety, advising Kumar approach officers if needed.
