The BJP government in Uttarakhand, led by Chief Minister Pushkar Singh Dhami, approved the draft of the Uniform Civil Code (UCC) manual on Monday, which has been allegedly criticised for targeting the Muslim community by banning the Muslim Personal Law applicable to marriage, divorce, inheritance, adoption, and maintenance under Islamic laws, while excluding the practices of tribal communities.

The dates for the law's implementation are expected to be announced shortly.

The UCC seeks to establish a unified legal framework governing marriage, divorce, inheritance, adoption, and maintenance for all religious communities. While India has a uniform criminal code, a similar framework for civil law has yet to be introduced. The law explicitly excludes tribal communities and bans practices such as 'halala', 'iddat', and 'talaq', which are part of Muslim Personal Law.

The Cabinet's approval followed the introduction of partial amendments to the rules recently drafted for the UCC. These amended rules, which were examined by the Law Department, were discussed and finalised during a meeting chaired by Chief Minister Pushkar Singh Dhami.

The committee drafted the UCC, which was passed with the President’s assent, and training for officials is now in its final stages. He added that the dates for the UCC’s implementation would be announced soon, and the rules were discussed in the Cabinet meeting.

On January 13, the Uttarakhand government began training officials to familiarise them with the UCC portal. This includes online portals for both citizens and officials, featuring Aadhaar-based verification, AI translation in 22 languages, and data integration across various departments. The system is cloud-based with disaster recovery.

The government also introduced separate fees for expedited registration, simplified live-in relationship termination processes, and online registration for wills. Extensive training programs are underway to ensure smooth implementation.

"During the 2022 elections, we assured the people of Uttarakhand that the UCC would be implemented once our government was in place. We have kept our promise — the draft committee prepared it, it was passed, and the President approved it, making it an Act. The training process is almost complete," he said.

He also highlighted the historic nature of the move, with Uttarakhand set to become the first state in India to implement the UCC. "The analysis is complete, and we have discussed it in the Cabinet today. The dates will be announced soon. Since we are setting a precedent, it is crucial to thoroughly prepare for its implementation," he added.

The UCC consists of 392 Sections spread across seven schedules, with the draft covering 750 pages over four volumes. A five-member expert committee, led by Retired Justice Ranjana Prakash Desai, was tasked with preparing the draft. The committee submitted the final draft to the state government on February 2, 2024.

The draft was approved by the State Cabinet on February 4 and subsequently passed in a special session of the Assembly. The legislation received the approval of Uttarakhand Governor Lt. Gen Gurmit Singh (Retd) on February 28, 2024, cementing its place in Indian legal history.
