Child in womb must be born as a free citizen: Delhi HC grants bail to pregnant woman
text_fieldsNew Delhi: Justice Poonam A Bamba of Delhi high court granted bail to an accused to take care of his pregnant live-in partner. The bail is granted for three weeks under the surety of the personal bond sum of Rs 30,000.
The couple was sent to jail for allegedly possessing fake ID proofs of RAW and IB. A Scorpio car with the stickers of the agencies was found parked outside by the police. The special cell found the woman of having two fake ID cards while examining the car which was parked outside their flat.
The assisted designations on the woman's ID card were 'Cybersecurity and law expert' for RAW and 'Anti-terrorist Squad' on the card for IB.
Whereas "Anti-Terrorism Squad, Designation, Training, Background, Information Check Bureau" was written on the man's IB card.
The woman was already granted bail following her pregnancy. "Since the accused mother is presumed to be innocent until proven guilty, her child to be born must also see the world as a free citizen rather than from behind bars with her mother," said the court while giving bail on April 20.
The man requested bail, asking permission to take care of his partner during the late stage of pregnancy. Although her grandparents have arrived from Assam, they might not be completely aid to help in emergencies due to health conditions.
"Considering that presently, except for her grandparents, who are in their nineties, there is no one to take care of the co-accused/live-in partner of the applicant/accused, the applicant/accused is admitted to interim bail," said the court in the bail.
However, the earlier submitted bail was rejected by the government, claiming severe offences to national security.
