New Delhi: Senior BJP leader Manjinder Singh Sirsa said jailed Chief Minister Arvind Kejriwal does not have the legal capacity to issue official orders from jail ‘without court’s permission’.

Kejriwal has been in the custody of the Enforcement Directorate since his arrest last week over the alleged liquor policy scam.

His arrest has spawned a situation where the Delhi’s ruling AAP has decided to allow Kejriwal to continue discharge his duties from the jail.

Sirsa approached Delhi Lieutenant Governor VK Saxena and the Enforcement Directorate questioning the arrangement which allows Kejriwal issue ‘orders’

‘This is totally illegal and unconstitutional... and a criminal conspiracy against the people of Delhi and the office of the Chief Minister. Kejriwalji is in ED custody and lacks the legal capacity to issue such directives without court permission, which has not been granted,’Sirsa was quoted as saying in a video statement.

Announcing his lodging of complaints with the Lieutenant Governor and the Enforcement Directorate, Sirsa said “Atishiji (Delhi's Education and Public Works Department Minister) and others who displayed an illegal order in the name of Chief Minister Arvind Kejriwal. They claimed the order was issued by the Chief Minister while in jail... while in the custody of the ED.”

From ED custody, Kejriwal issued his second instruction to the cabinet regarding ‘free medicines and path tests’ at the government’s clinics in Delhi.

Delhi’s Health Minister Saurabh Bharadwaj said the Chief Minister directed him to ensure free tests and medicines at the clinics after having "received information about problems" .

Atishi, Delhi's Education and Public Works Department Minister, tearfully quoted Kejriwal as saying that ‘people should not face any problem because I am in jail.’
