Are citizens cared for the same as cows, Gujarat HC asks DM

The bench of Justice Paresh Upadhyay of the Gujarat High Court on Friday asked District Magistrate Gir-Somnath if he gave the citizens in the area under his jurisdiction the same care claimed to have been taken on behalf of the state for cows, reports LiveLaw. The bench was hearing a plea challenging a detention order passed by the DM under the Gujarat Prevention of Anti Social Activities Act, 1985. The DM alleged that the petitioner had tied up his cattle so that it could not drink water.

The court repeated the question as it had posed the same question in its June 28 order and sought a reply by July 23. However, no reply was filed. The court has now given the DM time till August 13 to reply.

The court noted the impugned order as prima facie 'not sustainable'. The execution of the detention order stands suspended until the next hearing. If a reply is filed to the question posed by the court to the DM, it would also be taken into consideration before recording the final order, the court noted.
