The dissenting judgment could overturn majority view: P Chidambaram on note ban verdict
text_fieldsNew Delhi: The senior Congress leader Chidambaram said that the lone dissenting judgment from Supreme Court on currency ban could in future make ground for change in majority judgment.
The former finance minister also referred to two cases where the majority view was eventually overturned.
Chidambaram by way of example highlighted the upholding of the Emergency powers of the government by the ADM Jabalpur and added that the dissenting judgment of Justice Khanna turned out to be the majority view of the the Supreme Court.
Citing a similar case he said ‘Justice Chandrachud's judgment in an earlier case was overturned by Dr Justice DY Chandrachud’.
Observing that dissenting order will ensure the government not going for demonetization again, he said it could possibly become the law declared by the Supreme Court.
Adding further he said the majority view upholds neither the wisdom nor the idea whether objectives of demonetization were achieved.
When asked whether the objectives of demonetization matter, he said it mattered as it had put people through difficulty without still achieving its objectives.
He also said that the minority judgment explained that there was no consultation. It emanated from the Central government.
Justice BV Nagarathna in her dissenting judgment called the notes ban as "vitiated and unlawful".
Her voice disagreed with the majority view that the Centre's six-month-long discussions with the Reserve Bank of India met the requirement, according to NDTV.
