Techie suicide: Atul Subhash's mother moves SC for custody of grandson
text_fieldsNew Delhi: Eleven days after Bangalore techie Atul Subhash committed suicide, his mother, Anju Devi, filed a habeas corpus plea with the Supreme Court on Friday, asking all parties involved to promptly identify and present her grandson and grant her custody.
A two-judge Supreme Court bench, led by Justice BV Nagarathna and Justice N Kotiswar Singh, issued letters to the governments of Uttar Pradesh, Haryana, and Karnataka to act on the appeal and scheduled a further hearing for January 7.
Anju Devi, in her petition copy, acquired by The New Indian Express, stated that she was forced to move the SC after being deeply aggrieved by the illegal detention of her four-year-old grandson at an unknown location and under the custody of an unknown individual.
"I seek the search and production of the minor child before this Court by the Respondent Police Authorities herein and upon production for a direction to hand over the custody of the said child to the Petitioner (Anju Devi), who is the paternal grandmother," her petition stated, TNIE reported.
In this case, the father died and the mother was arrested. Her grandson's whereabouts and custody status are unknown, thus the Court should infer the child's custody to be unlawful and amount to illegal detention, according to her petition.
The petition stated that as the child's paternal grandmother, she was best prepared to care for him right now. She emphasised that she had petitioned the Supreme Court because she had no other options.
