SC notice to Gujarat govt on Sanjiv Bhatts petition against conviction, life sentence

New Delhi: In response to Sanjiv Bhatt's plea challenging the Gujarat High Court's decision to dismiss his appeal against his conviction and life sentence from the Jamnagar Court, the Supreme Court on Tuesday, August 27, served notice to the State of Gujarat.

The current case and the other ongoing pleas before the Supreme Court were tagged by the bench of Justices Vikram Nath and Prasanna Bhalachandra Varale along with the notice, according to LiveLaw. Senior attorneys Kapil Sibal and Devdatt Kamat stated that the subject requires a hearing and agreed with the court's suggestion that the case should be tagged with other ongoing cases before it while speaking on behalf of Bhatt.

Thereafter, the above order was passed and notice was made returnable within four weeks, the Wire reported.

The life sentence and murder conviction of Bhatt and police constable Pravinsinh Zala in a 1990 case involving allegations of torture and death in custody were affirmed by the Gujarat High Court in January of this year.

Following their conviction under sections 302 (murder), 323 (punishment for voluntarily causing hurt), and 506 (1) (punishment for the offence of criminal intimidation) of the IPC, a Sessions Court in the State's Jamnagar district sentenced Bhatt and a police constable (Pravinsinh Zala) to life imprisonment in June 2019, according to LiveLaw.
