Individual liberty is sacrosanct, bail plea to be heard expeditiously: SC
text_fieldsNew Delhi: The Supreme Court said that an application seeking bail must be taken up for hearing as expeditiously as possible. The apex court added that the liberty of an individual is "sacrosanct".
A bench of Justices Ajay Rastogi and A S Oka was addressing a plea filed by an accused taken into custody in March 2021. He urged the court that his bail plea pending before Punjab and Haryana High Court be heard soon.
A sessions court had dismissed the bail application seeking post-arrest bail after which he approached the High Court on July 7. It was listed before the court several times, but it could not be heard.
"No time limit can be fixed for applications seeking pre-arrest or post-arrest bail, but the minimal which can be expected is that such pleas be heard at the earliest. "Although no time limit can be fixed, that is the minimum which can be expected to give an audience at the earliest," reported NDTV.
