Delhi Court rejects plea for FIR against Kapil Mishra in 2020 riots case

New Delhi: A Delhi court on March 13 dismissed a plea to register an FIR against Law and Justice Minister Kapil Mishra over his alleged role in the 2020 Northeast Delhi riots.
Additional Chief Judicial Magistrate Ashwani Panwar at Rouse Avenue Court rejected the application by Yamuna Vihar resident Mohammad Ilyas. The complaint sought police action under Section 156(3) CrPC (now Section 175(3) BNSS) for cognisable offences, claiming Mishra blocked a road and destroyed vendors' carts in Kardam Puri on February 23, 2020, with senior police present.
Ilyas also accused Mustafabad MLA and Deputy Speaker Mohan Singh Bisht, plus former BJP legislator Jagdish Pradhan, of fuelling the violence that killed 53 and injured many.
The court ruled that the material did not justify an FIR at this stage. The case has a history: an earlier magistrate ordered further probe into Mishra's role, but a Special Court overturned it in November 2024. Judge Vinay Singh cited "serious jurisdictional error," noting the complaint lacked clear evidence of cognisable offences and exceeded the section's scope.
