BJP leader Yediyurappa moves HC seeking to quash Pocso case

Bengaluru: Senior BJP leader and former chief minister of Karnataka B S Yediyurappa on Wednesday approached the Karnataka High Court requesting to quash the case filed against him under the Protection of Children from Sexual Offences (Pocso) Act in March this year, The Indian Express reported.

Meanwhile, the Criminal Investigation Department (CID) of the Karnataka, which summoned Yediyurappa on Wednesday as part of the probe in the case, has sought a special court to issue arrest warrant for the former chief minister.

However, Yediyurappa earlier sought time to appear before CID claiming that he was away from Bengaluru, The Indian Express reported citing sources said.

Yediyurappa moved the High Court after the victim’s brother on Tuesday sought the court’s intervention to speed up the probe of the case which was filed on March 14, 2024.

The senior criminal and human rights lawyer S Balan filed the petition for the victim’s brother.

Yediyurappa in his petition sought to quash the case, saying that the case filed against him based on the complaint by the victim’s mother is false.

The former Karnataka chief minister reportedly said that he had helped the mother and daughter in the past.

The victim’s brother, who moved the High Court after the victim’s mother died on May 26, said in the petition that even after two months of registering the case the Karnataka Police have not progressed with the investigation.

“Accused was not arrested and not even 41(A) notice was given, hence this petition as there is no efficacious remedy other than approaching this Hon’ble Court for invoking its extraordinary writ jurisdiction,” the petition reportedly said.

The mother of the victim in the complaint against Yediyurappa said that the former Chief Minister had touched her daughter inappropriately in February at his residence where she had gone seeking justice in a 2015 case of assault on the child.

Meanwhile, Yediyurappa appeared before CID officers on April 12 to supply his voice samples in order to compare the voices on the video that the mother had recorded on the day of alleged incident.
