Default bail granted to accused could be cancelled: Supreme Court

New Delhi: A default bail granted to an accused can be cancelled if a special and strong case is being made out against them on filing a charge sheet, the Supreme Court ruled on Monday, PTI reported.

The court noted that merely filing a charge sheet does not suffice, but the court needed to be satisfied that a strong is made out against the accused so that they do not deserve bail.

The court said, "The bail granted to an accused can be cancelled on merits if a special and strong ground is made out on filing of a charge sheet and the courts are not precluded from considering a plea for cancellation of bail."

The court made the observation while directing the Telangana High Court to consider on merits the CBI's plea for cancellation of bail to Erra Gangi Reddy in connection with the murder of former Andhra Pradesh Minister Y S Vivekananda Reddy.

Vivekananda Reddy was the late Andhra Pradesh Chief Minister YS Rajasekhara Reddy's brother and current CM YS Jagan Mohan Reddy's uncle. On March 15, Vivekananda Reddy was found murdered at his residence in Pulivendula 2019.
