New Delhi: A civil suit has been filed, in the name of 'Bhagwan Srikrishna Virajman' seeking evacuation of Masjid Idgah, in Mathura Court.

The plea, which claims that the first petitioner, Srikrishna, is a minor, a juristic person and can sue and be sued through shebait, has been moved by Ranjana Agnihotri, the next friend of the plaintiff.

"He is minor. He is a juristic person. He can sue and be sued through shebait and in his absence through next friend. It can own, acquire and possess the property. It has every right to protect its property and to recover its lost property through shebait and in absence of shebait throught next friend by availing an appropriate remedy in Court of law."

The plea also claims that the second plaintiff, Srikrishna Janmabhoomi', the place believed to be the birthplace of Sri Krishna, as per the plaintiffs has 'special significance" in religious scriptures as well as under Hindu law.

The plaintiffs argued for the right under Article 26 of the Constitution of India to regain, hold and manage the property belonging to, owned and possessed by deity Sri Krishna Virajman.

The other five plaintiffs, who are devotees, sought to ensure Dharshan, pooja, rituals according to Vedic Sanatan Dharma, faith.

The plea contended that the birthplace of Krishna lies beneath the construction raised by Committee of Management i.e., Trust Masjid Idgah and claimed that the true fact will come out after excavation.
