Washington: In the United States, former president Donal Trump urged an appeals court to discard the federal subversion criminal case in Washington, DC. He argued before the federal court that he is protected by presidential immunity, Asian News International reports, citing CNN.
The former wishes the DC Circuit of Court Appeals to ditch a lower-court verdict, which rejected his claims of immunity in the case of election subversion.
The Supreme Court of the US refused to take Trump's appeal, on Friday, on an expedited basis.
CNN reports that Trump's filing argues that he was working in his official capacity to "ensure election integrity". His indictment is unconstitutional since presidents cannot be criminally prosecuted for "official acts" if they are not impeached and convicted by the state. The case against him alleges that he undermined the 2020 election results.
On Saturday, Trump's attorneys wrote that the Constitution establishes a powerful structural check to prevent political factions from abusing the formidable threat of criminal prosecution to disable the President and attack their political enemies.
They wrote that before any single prosecutor can ask a court to sit in judgment of the President's conduct, Congress must have approved of it by impeaching and convicting the President, which did not happen here. Therefore TrumpTrump has absolute immunity, they wrote.
CNN says that Trump has been attempting to delay his March 4 trial in the mentioned case, and his efforts over the immunity claim underscore it.
