Govt to give written explanation to Governor on anti-CAA move

Thiruvananthapuram: The Kerala government will give a written explanation to the governor who came out with an open war after the Citizenship Amendment Bill was challenged by the state in the Supreme Court. The government will explain that nothing wrong was done byfiling a suit without intimating the Governor with the move.

The explanation prepared by the Chief Secretary, after seeking the advice of the Advocate General, will be handed over to the Governor without delay. The written explanation has been prepared after the Governor publicly rejected the verbal explanation given by Tom Jose, the Chief Secretary after visiting the former at Raj Bhavan.

The Chief Secretary at that time had given the government's response.  As the Governor has rejected the reply, the state government will  now give written explanation which  will make it clear that the Governor was not bypassed deliberately. The letter will also point out that the Governor is not above the constitution. 

According to Article 131, the state government has the right  to approach the Supreme Court. However, citing the Conduct of Government Business under Article 166, the Governor had said that the government is liable to intimate the Governor before approaching the Supreme Court. However, the government argues that the Supreme Court had said in several cases that the government is not liable to follow Conduct of Government Business mandatorily.

The government believes that the Governor is acting with prejudices.  Though the Governor has made it clear that no explanation can satisfy him, the government wants to ensure that it complied with all the procedures as legally prescribed.
