Kerala HC Upholds Rs.1 Lakh Compensation to the illegally detained man

Kochi: In an interesting development, a Division Bench of Kerala High Court on Monday dismissed Kerala government’s appeal against the 2015 judgment of the single bench ordering a compensation of Rupees One Lakh to a man having been illegally detained on the suspicion of being a Maoist.

The incident took place on May 20, 2014, when Shyam Balakrishnan, an author/researcher residing in Wayanad, was blocked by two plain clothes on his way; later taken to police station, he was strip searched. Soon, officers of ‘ Thunder Bolt’ searched his home and seized his books and laptop.

Shyam Balakrishnan, son of a retired High Court judge, filed a petition. Later, the court ordered the state government to pay a compensation of Rs. 1,00,000/- to the petitioner.

The government challenged this order, which the court on Monday dismissed.
