New Delhi: The Supreme Court on Tuesday rejected a petition by Kerala Muslim Jamaat seeking to shift the embarkation point for Haj pilgrims from Kerala to Karipur instead of the current Nedumbrassery.
The Supreme Court order came during the pendency of a similar petition by Kerala Haj Committee, and after hearing the later petition, issued its judgment.
As per SC precedent, when a demand has been rejected by the apex court, any other petition with the same demand will be rejectged. Therefore, this judgment may be applicable to, and affect the Kerala Haj Committee petition.
In the normal course, the Supreme Court considers petitions of similar or related subjects all together. However, prior to the Kerala Haj Committee petition coming up for hearing, the Muslim Jamaat plea was posted for hearing by the bench headed by Chief Justice Dipak Misra.
As soon as the petition was taken up, the Court rejected it. All the same, when a similar petition was considered last year, the Court had observed that the Central Government could reconsider the order making Nedumbrassery the embarkation point for Haj pilgrims from Kerala, if it wanted to.
