New Delhi: The Delhi High Court has come down hard on the Uttar Pradesh police department after the latter allegedly arrested two men in Delhi without informing the Delhi Police. The UP police had registered a case against the family of a man who eloped with a woman from UP to Delhi where he stays with family.

"This will work in UP but not in Delhi," the court headed by Justice Mukta Gupta was quoted as saying in reports. "We will not tolerate this in Delhi. If you work with your eyes and ears covered, there is no remedy for it here."

The court asked why a case had been filed under Section 366, 368 of the IPC even though the woman was not a minor and had left home to marry the lover of her own free will. In addition to this, the woman was not even consulted in the matter nor her statement taken before the police acted on the FIR, the judge noted.

The court passed the order in the petition of a couple, who stated that they got married willingly on July 1, 2021. However, the court was told that the woman's parents are against the marriage and have been repeatedly threatening them. The UP police had arrested the father and brother of the man from their residence in Delhi on September 8 the petition filed by the couple states. They also claimed that the whereabouts of the two men is unknown although the Delhi Police report states that the men were arrested in Shamli, UP on the behest of a complaint filed by the woman's mother.

The SHO of Shamli police station in UP has been asked to appear before the Delhi court on Thursday along with the case file.
