Rajasthan HC cancels allotment of public utility land to Adani-owned company

Jaipur: The Rajasthan High Court division bench on Tuesday cancelled the allotment of public utility land of about 1,452 bighas near Pokhran in Jaisalmer to Adani Renewable Energy Park Rajasthan Limited (AREPRL). In 2018, the Adani group-owned company was allotted 6,115 bighas at Nedan village near Pokhran to set up a solar plant.

However, the bench of Justices Sangeet Lodha and Rameshwar Vyas directed the state government to conduct a survey on the land allotted to AREPRL and Essel Surya Urja Company of Rajasthan Ld (ESUCRL) in Naden, Ughras and Nagnechinagar and cancel the allotment if any part of it is allotted on public utilities.

The court was hearing a petition by Barkat Khan and 23 others objecting to the state government's allotment of public utility land to solar companies. It directed that the allotment of land around the lands of the petitioner, other khatedar tenants and land of public utilities be reviewed to ensure that their rights are not infringed by the land allotment to solar power companies.

It further ordered that the land for the road to the lands of khatedar tenants and the dhani of the inhabitants of the village be specifically set apart and entered into revenue records for the said purpose.

The court has directed the state government to exercise the directives of the court within six weeks of receiving the certified copy of the order.
