LG's Appointment of Special PPs for Delhi violence challenged in HC
text_fieldsNew Delhi: A plea has been filed in Delhi High Court challenging the Lieutenant Governor's appointment of eleven Special Public Prosecutors for conducting cases pertaining to the violence in the northeast Delhi.
Delhi Prosecutors Welfare Association, the petitioner, contended that the notification issued by the LG without the aid and advise of the Delhi Government is unsustainable.
The petition pointed out that the LG Governor proceed with the appointments as recommended by the police, though the elected government had rejected it.
The conflict arose as the Delhi Police is reporting to the Union Ministry of Home Affairs.
The petitioner argued that the appointments violate Article 21 of the constitution which guarantees free and fair trial to every accused person.
The appointment of Special PPs in cases related to Delhi violence has been a bone of contention between the Delhi Government and the Delhi LG.
The Delhi government had objected to the appearance of Solicitor General Tushar Mehta on behalf of the government saying that the appointment of prosecutors was prerogative of the elected government.
