Allahabad HC strikes down UP Madarsa Board Act calling it unconstitutional
text_fieldsThe Allahabad High Court has declared the Uttar Pradesh Board of Madarsa Education Act, 2004, as "unconstitutional" and in violation of secular principles, directing the state government to accommodate current students of madrasas into the formal schooling system.
The ruling, handed down by a division bench comprising Justice Vivek Chaudhary and Justice Subhash Vidyarthi of the Lucknow branch of the court, came in response to a writ petition filed by Anshuman Singh Rathore.
Rathore challenged the constitutionality of the UP Madarsa Board and raised objections to the management of madrasas by the Minority Welfare Department, both at the Union of India and the state government levels.
The court's decision underscores the importance of upholding secularism and ensuring equal educational opportunities for all students, irrespective of their religious affiliations.
The state government has been instructed to take appropriate measures to facilitate the transition of madrasa students into formal schools, ensuring continuity in their education and safeguarding their rights.
