New Delhi: The Supreme Court on Thursday set aside orders issued by Patna High Court in an anticipatory bail case, including the one that directed Sahara Group head Subrata Roy to appear before it, PTI reported.
The high court had passed the orders on February 11 and April 27 while hearing an anticipatory bail application submitted by another person.
On Monday, the Supreme Court said that while entertaining the plea for grant of anticipatory bail, the high court inquired about matters not related to the facts relevant to deciding on the plea.
The SC bench of Justices AM Khanwilkar and JB Pardiwala said, "In the present case, we have noticed that the high court kept the application for grant of anticipatory bail pending and issued directions, including to issue notice to third parties to appear before the court. That, in our opinion, is impermissible and cannot be countenanced."
The top court had earlier stayed the order passed by the high court, which had on February 11 directed to add Sahara Credit Cooperative Societies Limited and Subrata Roy as opposite parties to a bail petition pending before it and later directed him to appear before it personally.
On April 27, the high court directed Subrata Roy to personally appear before it, noting that Sahara Group and other companies, which had been taking deposits till about one month back, were directed to come up with a plan for the return of investment of the investors.
