State cannot take benefits of own wrongs: Supreme Court

New Delhi: Upholding a Gujarat High Court order, Supreme Court ruled that the State cannot take the benefits of its own wrongs. The High Court had directed the state government to pay a man his pensionary benefits for his 30 years plus years of service, PTI reported.

The top court bench of Justices MR Shah and BV Nagarathna said that after taking the continuous service of a person for 30 years and contending that the employee is not eligible for pension is nothing but unreasonable. India is a welfare State, and the State should not have taken such a stand, the court said.

Further, the SC observed that in the case, the High Court had not committed any error in directing the government to pay the pensionary benefits to the respondent.
