Kerala HC grants anticipatory bail to expelled Cong MLA Rahul Mamkootathil in first rape case

Kochi: The Kerala High Court on Thursday approved anticipatory bail for Palakkad MLA Rahul Mamkootathil in the initial of three rape cases, imposing strict conditions. This secures bail across all three, following prior grants in the others.

Prosecution opposed, arguing the MLA mentally manipulated and exploited the complainant, necessitating custody for interrogation. The woman claimed bail endangered her life and accused him of abusing others.

After scrutinizing her statement, the court found insufficient proof of rape. It remarked that a married woman's extramarital relationship isn't inherently illegal or immoral, insufficient alone to deny bail. However, it noted potential added charges if explicit images surface.

Conditions include surrendering his phone and passport, medical tests, and daily questioning from February 16 for three days (10 a.m. to 4 p.m.), treated as custody. He cannot leave Kerala, must report biweekly on second Saturdays, avoid witness contact or threats, and refrain from offenses.

The ruling may stir political waves, amid questions over his Palakkad seat.
