New Delhi: The Supreme Court on Tuesday said it would list on May 15 the plea challenging the Kerala High Court's refusal to stay the release of the movie 'The Kerala Story’, LiveLaw reported.
Senior Advocate Kapil Sibal requested the bench comprising CJI DY Chandrachud and Justice PS Narasimha to consider the matter urgently, saying that ‘This is pertaining to the Kerala story. This has some sort of urgency. The High Court has passed the order, they've refused the interim stay.’
The Kerala High Court on May 5 refused to stay the release of the controversial movie, according to the report.
A division bench comprising Justice N. Nagaresh and Justice Sophy Thomas observed that the movie had been certified by the Central Board of Film Certification (CBFC) , adding that it was ‘inspired by true events'.
Alongside, after watching the trailer of the movie the bench said that there was nothing offensive in it against any particular community.
As well as noting that the petitioners had not watched the movie, the court pointed out that the producer added a disclaimer saying that movie was a ‘fictionalised version of events’.
The High Court also recorded the producer’s submission that the teaser of the movie claiming the recruitment of over 32,000 women from Kerala to ISIS will be removed from social media accounts.
The Supreme Court earlier refused to hearing a plea against the movie, directing the petitioner to move to the High Court again.
