"The Bombay High Court said that schools teaching their students standard moral values don't need to worry about them being affected by the liquor restaurants nearby.
The Bench was addressing a plea challenging the State excise department's order granting a liquor license to a restaurant named Hotel Moonlight near a school. The Principal Secretary of State Excise Department observed that the restaurant was beyond the 75-meter statutory distance from the school.
Justice GS Kulkarni observed that the Commissioner of State Excise had appropriately considered the clear position in law as required by the rules and had passed a well-reasoned and detailed order. The Bench further noted that there was no material from the police department to suggest any law-and-order situation, reported Live Law.
It was also taken into account that there was a similar restaurant with a liquor license functioning in the vicinity of the school for the last 10-12 years. The school owners never raised objections against the establishment.
