New Delhi: In the matter of caste-based census to which the Patna High Court put an interim stay, the Supreme Court judge Justice Sanjay Karol recused from hearing the Bihar government’s plea challenging the high court order, Asian News International reported.
Justices BR Gavai and Sanjay Karol were supposed to hear the matter.
After the Patna High Court put the stay, Bihar Government moved Supreme Court through advocate Manish Singh.
The Patna High Court pronounced the order on May 4, putting an interim stay on the enumeration of castes and economic survey in Bihar. HC panel had completed the hearing on May 3 but reserved its judgement for a day on the petition challenging and seeking an interim stay in castes and economic survey in the state.
It was on January 7 the state government launched the caste survey exercise. On April 28, the Supreme Court refused to admit a plea that challenged the Bihar government’s move to run the caste-based survey. The top court directed the petitioner to move to the high court.
Further, the SC directed the Patna High Court to adjudge the matter fast.
