New Delhi: After a man was found illegally detained in jail for five days, the Patna High Court ordered him to pay him compensation of 5 lakh. The court noted that the man was granted bail, but he was illegally kept in jail, The Indian Express reported.
The court ordered that the state must pay the man compensation within a month.
The order by the court of justices Rajeev Ranjan Prasad and Sourendra Pandey said, “A consolidated amount of Rs 2 lakh would be a reasonable amount which may be awarded to the petitioner by way of compensation for his unauthorized detention by the Jail Superintendent, Central Jail, Gaya Jee,” TIE quoted.
The court made the ruling after it was informed that the man was facing charges under the anti-liquor law in Bihar. He was granted bail by a trial court, and warrants for his release were issued on September 29.
According to TIE, the superintendent of the jail concerned received a production warrant from a magisterial court in Buxar requiring the production of the man in another case registered for theft. But the jail superintendent did not produce him before the Buxar court on September 4, despite the production warrant. It is alleged that the man was kept in confinement on the basis of the production warrant.
The man argued before the high court bench that the date fixed in the production warrant had already expired, and once the date expired and the order of release reached the Superintendent of Central Jail, Gaya, the accused should have been released, TIE reported.
