‘Hindu gods fictional’: petition seeks case against CJP protest victim

New Delhi: A lawyer has approached a Delhi court seeking police action against a man, who got assaulted during CJP protests in New Delhi, and his daughter over alleged social media posts that purportedly insult Hindu deities, after claiming that her complaints to the police have not resulted in action.

The petition before the Chief Metropolitan Magistrate seeks directions to the Delhi Police to register a case and investigate Sanjay Azad and his daughter, Nishu Azad. The lawyer said she first approached the New Delhi district cyber police station on September 5 and subsequently submitted a complaint to the district DCP on September 7.

The complaint centres on four posts allegedly shared from Nishu Azad’s X account between 2023 and 2026. According to the petition, the posts included remarks describing Hindu deities as fictional, an alleged call to destroy Hindu religious scriptures, mockery of Shiva worship and allegedly derogatory references to Goddess Durga.

The lawyer claimed the posts remain publicly accessible and have hurt her religious sentiments. She has also sought preservation of the posts, related documents, platform information and other electronic evidence to prevent their loss or alteration during the investigation.

The petition raises questions over Nishu Azad’s age, suggesting she may be a minor and asking police to establish her age. It also seeks an inquiry into whether Sanjay Azad was aware of or exercised control over the account.

The lawyer cited a 2023 Supreme Court direction concerning police action against communal hate content and sought an FIR, an investigation, the preservation of digital evidence, and an action-taken report.

The case comes amid another police action involving Sanjay Azad, who was allegedly assaulted during a CJP protest at Jantar Mantar. Police had arrested Swatantra Bhardwaj in connection with that case.
