Prayagraj: The Allahabad High Court dismissed a plea filed by a live-in relationship couple who sought protection from their police as well as relatives as their relationship was interfaith. The woman (petitioner 1) in the couple who filed the petition is married to another man, is employed in the police department, and is on childcare leave. Her live-in partner (petitioner 2) is also married and the father of a 12-year-old child.
Dismissing their plea, a bench of Justice Vinod Diwakar also imposed a fine of Rs 50,000, Live Law reported.
The court said that the fine it imposed on the petitioner was for moving HC for protection, concealing the fact that Petitioner 2 started living with Petitioner 1 without divorcing his wife. The petitioners had moved HC for protection from police, stating they are an interfaith couple and are living against their parent's wishes.
"The petitioners have filed the instant writ petition by concealing the material facts. Hence, the writ petition, being devoid of merits, is dismissed with a cost of Rs 50,000," the court observed in its order.
The court noted that there was material concealment in the case matter, dismissing the couple's plea and directing them to deposit the fine within thirty days from the day of the ruling.
