Delhi High Court seeks Patanjali’s response to Dabur’s allegations over disparaging ad
text_fieldsThe Delhi High Court has asked Patanjali Ayurved to respond to a lawsuit filed by Dabur, accusing the company of airing advertisements that disparage its flagship product, Dabur Chyawanprash.
Justice Mini Pushkarna, on December 24, issued summons to Patanjali Ayurved and Patanjali Foods Ltd., directing them to file a written statement within 30 days. The court's order stated, “The plaint shall be registered as a suit. Issue summons. The defendants are to submit their written reply within 30 days.”
Dabur, which holds over 60% market share in the Chyawanprash segment, alleged that Patanjali's advertisements for its Special Chyawanprash contained false and defamatory claims.
According to Dabur, Patanjali portrayed its product as the “original” and “best” Chyawanprash, made following the “charak, sushrut, dhanwantari, chyawan sage tradition.” The advertisements also allegedly claimed that other manufacturers lack this knowledge and produce “ordinary” Chyawanprash.
The plea further stated that Patanjali’s campaign dismissed other Ayurvedic texts referenced in the Drugs and Cosmetics Act's first schedule, promoting its method as the only authentic formula for making Chyawanprash.
Dabur has requested a permanent injunction to stop Patanjali from broadcasting the advertisements or making statements that harm Dabur’s goodwill, reputation, and its product, Dabur Chyawanprash.
The court has also issued a notice regarding an application for interim relief. The case will next be heard on January 30.
